Automatic vs. petition-based expungement

While Michigan now automatically clears certain records, the automatic system has limits. Many people still need to file a formal petition with the court to achieve a full clean slate.

Automatic expungement: Since April 2023, certain non-violent misdemeanors (after 7 years) and up to two non-violent felonies (after 10 years) may be cleared automatically by the state.
Petition-based expungement: This is often the better path for those who don't want to wait 7–10 years. By filing a petition, we can often clear records much sooner—3 years for most misdemeanors and 5 to 7 years for felonies.

What convictions can be expunged?

The 2025 standards allow for a broader range of set-asides than ever before, including:

Misdemeanors: Unlimited regular misdemeanors can now be set aside.
Felonies: Up to three felonies can be expunged in a lifetime.
Traffic offenses: For the first time, most traffic convictions (excluding those causing injury or death) are eligible.
First-offense DUI: First-time OWI convictions can now be petitioned for expungement after a 5-year waiting period.
Marijuana offenses: Convictions for behavior that is now legal under Michigan's recreational marijuana laws.
